Article 3 – Applicability
These general terms and conditions apply to every offer from the entrepreneur and to every concluded distance contract between entrepreneur and consumer. Before the contract is concluded, the text of these general terms and conditions is made available to the consumer. If this is not reasonably possible, it will be indicated in advance that the general terms and conditions can be viewed at the entrepreneur’s premises and will be sent free of charge upon request. In the case of electronic contracts, the text of these conditions is made available to the consumer in such a way that it can be easily stored on a durable medium. If this is not possible, it will be indicated before the conclusion of the contract where the general terms and conditions can be consulted electronically and that they will be sent electronically or otherwise free of charge upon request. If specific product or service conditions apply in addition to these general terms and conditions, in the event of conflicting provisions, the consumer may always invoke the provision most favorable to him.
Article 4 – The offer
If an offer has a limited duration or is subject to conditions, this will be explicitly stated in the offer. The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable the consumer to make a proper assessment of the offer. If the entrepreneur uses images, these are a true representation of the products and/or services offered. Each offer contains such information that it is clear to the consumer what rights and obligations are attached to accepting the offer.
Article 5 – The agreement
The agreement is concluded, subject to the provisions of paragraph 4, at the moment of acceptance by the consumer of the offer and compliance with the conditions laid down. If the consumer has accepted the offer electronically, the entrepreneur immediately confirms receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed by the entrepreneur, the consumer may dissolve the agreement. If the contract is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a secure web environment. If the consumer can pay electronically, the entrepreneur will take appropriate security measures for this.
ARTICLE 6 – RIGHT OF WITHDRAWAL
In the purchase of products, the consumer has the right to terminate the agreement within 14 days without giving any reason. This reflection period starts on the day after the consumer receives the product or a representative designated by the consumer and made known to the entrepreneur.
During this reflection period, the consumer must handle the product and its packaging with care. The product may only be unpacked or used to the extent necessary to assess whether the consumer wishes to retain the product. If the consumer exercises his right of withdrawal, the product must be returned to the entrepreneur with all accessories provided and, if reasonably possible, in the original condition and packaging, in accordance with the reasonable and clear instructions provided by the entrepreneur.
The right of withdrawal can be exercised by informing us of the decision to withdraw from the agreement by means of an unequivocal statement, for example by email to info@freddyjunta.com.
After receiving the notification, we will provide a return code (label), with which the consumer can return the products. Products returned without a valid return code will not be processed, and no refund will be given.
The obligation to return in a timely manner is deemed to have been fulfilled if the products are returned within the specified period of 14 days.
To meet the withdrawal deadline, it is sufficient for the consumer to send the notice regarding the exercise of the right of withdrawal before the withdrawal period of 14 days has expired. Upon withdrawal, all payments received from the consumer, including any shipping costs, will be refunded within 14 days of receiving the returned products. The refund will be made using the same payment method as that used by the consumer for the original transaction, unless expressly agreed otherwise.
The consumer must return the receipt received upon delivery of the product, together with the product to be returned. The product must be returned in the original packaging, with accompanying instructions and documentation.
Upon receipt of the returned products, we will thoroughly examine them and inform the consumer of the right to a refund of the amounts paid. The refund will be made as soon as possible, but no later than 14 calendar days from the date the consumer informed us of his intention to withdraw from the agreement.
At Freddy Junta, all products are made to order, so exchanges are not possible. For questions or further assistance, consumers can always contact our customer service via info@freddyjunta.com. We are here to help and answer questions.
Article 7 – Costs in the event of withdrawal
If the consumer exercises his right of withdrawal, the costs of return shipping will be borne by him at most. If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than 14 days after withdrawal. This will be done using the same payment method used by the consumer for the original transaction, unless expressly agreed otherwise; in any case, no costs will be charged for such refunds.
